It is important for a USPS lease to include an accurate description of the premises leased to the USPS.  If the USPS leases an entire parcel, the legal description of the parcel should be used.  If the USPS leases only a portion of a larger legal parcel, then the legal description will need to be modified to accurately state the part leased to the USPS.

Detailed legal descriptions can be attached to a USPS lease as an exhibit that is incorporated into the lease.  Also, it is good practice to include the assessor’s tax parcel number with the legal description.  If the lease contains a tax reimbursement rider, the parcel number will be required.  Even if no such rider is part of the lease, the tax parcel number helps to further identify the property.

Whether as part of a new lease or in conjunction with a lease renewal, it is advisable to compare the legal description in the lease to the legal description in the recorded deed.  That way, any corrections can be made before the lease or lease renewal is signed.  After a lease or renewal is signed by both parties, changes must signed by both the landlord and the USPS.
